Morningstar Urban Development Inc., a HUD Approved Counseling Agency understands the courage it took for you to contact us and we commend you for taking your first step to help. We understand how hard that can be and promise to work as hard as you do to find a resolution to your situation.

To assist us in providing you with the most effective and efficient service, please complete the attached Intake Packet as thoroughly and accurately as possible. Also, please be as accurate as possible with the Monthly Spending Plan and fill out ALL of the information to the best of your knowledge; as this information is the key element of resolving your financial situation. After you have completed the entire Homeowner Application, we will go over it together during the housing counseling session.

We request and emphasize full and detailed disclosure of your information and circumstance in order that we can help derive the best solution for your situation. We emphasize being truthful. A plan based on only part of your information is certain to fail. Therefore, please fill out, sign, and initial each page. Please gather the documents listed below and return it to our office as soon as possible so our Counselors can provide full and accurate Housing Counseling Services.

HELPFUL TIPS

If you are less than three months past due on your mortgage payment, it is likely that you are speaking with the Collections Department. Their goal is to collect the payment not to provide modification or foreclosure intervention assistance.
Most lenders will move all mortgage loans with three or more missed mortgage payments to the Loss Mitigation Department. This department will collect financial information from the customer to determine what alternative they may offer to the customer.
Things you should consider if you are seeking assistance in reducing your interest rate in order to reduce your mortgage payment.
- The servicer wants a good faith payment upfront. It becomes more difficult to approve a loan modification or any other type of retention assistance if you have no money to pay upfront. “If the reason you stop making your mortgage payments is because your mortgage payments increase by $400.00 monthly you should have at least the previous mortgage payment saved before the increase.”
- Your budget is the “make or break” deal. You must be willing to create a crisis budget and reduce spending if you truly want to keep your house. The servicer/lender will usually provide assistance to customers that are no more than 10-15% over their net monthly income.
Foreclosure Intervention Counseling works best when you:
- Provide copies of all the needed documents AS SOON AS POSSIBLE
- Limit the number of telephone calls made to the Counselor
- Are able to take ownership of the situation and be realistic about the available options
- Ask questions and ensure you understand the process and available options
Our agency makes an assessment of each case and determines its urgency.
- Level 1 – Customer has a scheduled sale date for the courts to sale the house
  - Counseling appointments* typically are schedule within 7 days if the client provides all documents prior to the appointment.
- Level 2 – Customer has been served a Lis Pen dens
  - The client has 20 days from the date served to file a response to the Lis Pendens (complaint). Our agency DOES NOT write response letters. Your response is to the courts in regards to what the lender is filing a complaint. It may delay the scheduling of the court date but it usually will not stop the foreclosure process.
  - Counseling appointments* are scheduled after all requested documents are provided and typically within 10-20 days depending on the counselor’s schedule.
- Level 3 – 3 to 6 months of missed payments without being served a Lis Pendens
  - Counseling appointments* are schedule after all requested documents are provided and typically within one month depending on the counselor’s schedule.
- Level 4 – 3Less than three months of missed payments
  - Counseling appointments* are scheduled after all requested documents are provided and typically within one month depending on the counselor’s schedule.

*Please Note: Children are not permitted in any counseling session.

Customer must provide copies all requested documents to the intake specialist before a face to face appointment is scheduled. Documents are to be submitted within 10 days of receiving the Foreclosure Intervention Packet. Failure to submit the documents will delay or close your file.
1. VERY IMPORTANT THAT CUSTOMER HAS ALL NEEDED DOCUMENTS IN ORDER TO ANSWER ALL QUESTIONS ANS GATHER AS MUCH INFORMATION ABOUT YOUR SITUATION.
2. PROVIDE A DETAILED BUDGET OF YOUR INCOME AND EXPENSES.
  
  *** MOST LENDERS WILL PROVIDE SOME SORT OF ASSISTANCE IF YOUR BUDGET IS REASONABLE AND YOU CAN FINANCIALLY DEMONSTRATE A NEED FOR A LOAN MODIFICATION***
Once documents are received and reviewed a face to face counseling appointment will be scheduled. Your appointment is schedule according to your level of priority.
The foreclosure counselor will discuss your possible options and budgets during your face to face counseling appointment. An action plan will be developed and all disclosures will be signed.

Provide access to housing and financial services regardless of race, color, religion, sex, national origin, elderliness, familial status or disability.
Inform you of your rights and responsibilities to receive services and allow you to participate in all service decisions.
Provide you with enough information during intake to make educated and informed choices about using agency services, including expectation, hours and rules of conduct.

Privacy Disclosure

MUDI takes extreme care to ensure all clients’ right to privacy and confidentiality are maintained. All client information is maintained in a locked facility or is password protected. Only authorized staff may access confidential information and use the minimum amount of information necessary to accomplish work duties. Client information is only released with written or verbal authorization from the client.

Conflict of Interest Statement

I understand that while receiving any service from or working with MUDI, whether receiving Housing and Financial Counseling or any form of Education; often information on financial management, loan products, service providers, affordable housing options, alternative service program and products may be explained and/or recommended by MUDI staff or other service providers. I further understand that I am entitled to receive any and all of the above-mentioned services, information and recommendations at the price described in the fee schedule. Payment for credit report(s) is expected in full at the time of session, in the form of debit/credit card, money order or certified check. I understand I am under obligation to utilize any of these services, information or recommendations unless it is a requirement of one of MUDI’s Programs.

Dispute Resolution Process & Fair Housing Complaints

We are committed to providing fair, quality, professional services. However, if you are not satisfied with the services provided or if you believe your rights have been violated, we ask that you follow these steps:
Step 1: Try to resolve the issue with the staff member involved, giving him or her specific information about your complaint.
Step 2: If Step One is not possible or the issue is not resolved to your satisfaction, write or call Carne Mahone, Executive Director, at 770-497-4037. MUDI may request a meeting with you by phone or in person and/or seek information from staff person(s) involved. You will receive a response within 15 days.

We realize that the concerns you bring to us are highly personal in nature. Information you provide on applications/forms or other forms of communication. This information may include your name, address, Social Security Number, employer, occupation, account numbers, assets, expenses, and income.
Information about your transactions with us, our affiliates, or others; such as your account balance, monthly payment, payment history, and method of payment.
Information we receive from a consumer credit reporting agency; such as your credit bureau reports, your credit and payment history, your credit scores, and/or your creditworthiness.
We do not sell or rent your personal information to any outside entity.
We may share anonymous, aggregated case file information; but this information may not be disclosed in a manner that would personally identify you in any way. This is done in order to evaluate our program, gather valuable research information, and/or design future programs.
We may also disclose personal information about you to third parties as permitted by law.

How is your personal information secured?

We restrict access to your nonpublic personal information to MUDI employees who need to know that information in order to perform their housing counseling duties. We maintain physical, electronic, and procedural safeguards that comply with federal regulations to guard your nonpublic personal information; and we train our staff to safeguard client information and prevent unauthorized access, disclosure, or use.

Opting Out of Certain Disclosures

You may direct MUDI to not disclose your nonpublic personal information to third parties (other than disclosures made to project partners and those permitted by law). However, if you choose to opt out, we will not be able to answer any questions from your creditors, which may limit MUDI’s ability to provide services such as foreclosure prevention counseling. If you choose to opt-out, please sign below under the “Opt-Out” clause. If you choose to release your information as stipulated in this Privacy Policy, sign under the “Release” clause. You may change your decision any time by contacting our agency.

This list also identifies alternative agencies that provide services, programs, or products identical to those offered by MUDI and its exclusive partners and affiliates.

Errors and Omissions and Disclaimer of Liability: I/we agree MUDI, its employees, agents, and directors are not liable for any claims and causes of action arising from errors or omissions by such parties, or related to my participation in MUDI counseling; and I hereby release and waive all claims of action against MUDI and its affiliates. I have read this document, understand that I have given up substantial rights by signing it, and have signed it freely and without any inducement or assurance of any nature and intend it to be a complete and unconditional release of all liability to the greatest extent allowed by law. If any provision of this document is unenforceable, it shall be modified to the extent necessary to make the provision valid and binding, and the remainder of this document shall remain enforceable to the full extent allowed by law.
Quality Assurance: In order to assess client satisfaction and in compliance with grant funding requirements, MUDI, or one of its partners, may contact you during or after the completion of your housing counseling service. You may be requested to complete a survey asking you to evaluate your client experience. Your survey data may be confidentially shared with MUDI grantors such as HUD or Esperanza.

I understand that Morningstar Urban Development, Inc. (MUDI) provides confidential pre-purchase, post-purchase, and foreclosure prevention housing counseling after which I will receive a written Action Plan consisting of recommendations for handling my finances, possibly including referrals to other housing agencies as appropriate.

(MUDI) Housing Counseling Agency may be in partnership with my lender, servicer or insurer and may require that MUDI share my information with my servicer to better assist me. Obtain a copy of the HUD-1 Settlement Statement, Appraisal, and Real Estate Notes from the lender and/or the title company that closed the loan if I purchase or refinance.
Permit MUDI or its authorized representatives, duly designated third-party contractors and or agents (for programs evaluations purposes) to retrieve and review client’s credit information and records, including credit reports, up to two (2) additional times between now and the next three years and to conduct follow-up interviews/communications with clients for program evaluations purposes.

Authorization is further granted to the Counseling Agency to use photocopy of my/our signatures below, to obtain information regarding any of these items.

Part of the mission of the Morningstar Urban Development, Inc. is to empower families and individuals to obtain and retain assets. By accepting MUDI’s homeownership counseling services, I acknowledge that I am in no way obligated to participate in any other program or service offered by MUDI, or to use the services of any of the MUDI Partners or associates.

We assure you that all information shared both orally and in writing will be managed within legal and ethical considerations. Your “non-public personal information,” such as your total debt information, income, living expenses and personal information concerning your financial circumstances, will be provided to creditors, program monitors, and others only with your authorization and signature on the Housing Stability Counseling Program Counseling Authorization Agreement. We may also use anonymous aggregated case file information for the purpose of evaluating our services, gathering valuable research information, and designing future programs.

Information we receive from you orally, on applications or other forms, such as your name, address, social security number, assets and income; and
Information about your transactions with us, your creditors, or others, such as your account balance, payment history, parties to transactions and credit card usage; and
Information we receive from a credit reporting agency, such as your credit history.

You have the opportunity to “opt-out” of disclosures of your non-public personal information to third parties (such as your creditors), that is, direct us not to make those disclosures
